1. About these terms
Rated5 is a business-to-business (B2B) service — these terms apply to businesses ("you", "your business") that sign up to use Rated5, a digital food-safety diary for UK hospitality operators, currently operated by its founder, Ben Bowen, trading as Rated5.
2. The service
Rated5 lets you record temperature checks, daily checklists, cleaning schedules, corrective actions, safe methods, training records and related food-safety documentation, structured around the FSA's Safer Food Better Business framework. It's a tool to support your food-safety record-keeping — it does not replace your business's own legal duty to comply with UK food-safety law, and using Rated5 doesn't transfer that responsibility to us.
3. Free trial
New accounts get a 14-day free trial with full access to the app — no payment card is required to start. If you don't subscribe by the end of the trial, your account is paused, not deleted: the account owner can still log in, export every record, and subscribe at any time to pick back up exactly where you left off.
4. Subscriptions and pricing
Rated5 is priced per premises, billed either monthly or annually, at the rate shown on our pricing page at the time you subscribe. All prices shown are the amount you pay — we are not currently VAT-registered, so no VAT is added at checkout.
Switching from monthly to annual billing takes effect immediately, with a prorated charge for the remainder of the current billing period. Switching from annual back to monthly takes effect at the end of your current annual period, since that period is already paid for. Adding an additional premises to an active subscription is billed on a prorated basis for the rest of the current period; removing one reduces your bill going forward with no refund for the current period.
5. Payment
Payments are processed by Stripe. We never receive or store your full card details — only the card brand, last four digits, and expiry date, for your own reference. If a payment fails, your account keeps full access for a grace period while we attempt to recover payment; if it's not resolved within that window, the account is paused in the same way as an unconverted trial.
6. Cancellation
You can cancel at any time. Your subscription remains fully active until the end of the period you've already paid for, then ends — we don't offer partial refunds for unused time. Cancelling does not delete your data: there is no automatic deletion or retention-window process, and the account owner can export a complete copy of every record, for every premises, at any time before or after cancelling.
7. Acceptable use
You agree not to:
- Use Rated5 for any business other than genuine food-safety record-keeping for your own premises
- Attempt to circumvent, disable, or interfere with the security or integrity of the service
- Enter knowingly false records, or attempt to falsify the immutability of the diary
- Share your login credentials — every team member should have their own account
8. Availability
We aim to keep Rated5 available and reliable, but we don't guarantee uninterrupted access. Rated5 is provided "as is" — we're not liable for losses arising from downtime, data loss, or service interruption beyond our reasonable control, except where the law doesn't allow us to exclude that liability.
9. Liability
To the fullest extent permitted by law, our total liability to you arising from your use of Rated5 is limited to the amount you've paid us in the 12 months before the claim arose. We're not liable for indirect or consequential losses. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
10. Changes to these terms
We may update these terms from time to time. We'll update the "last updated" date above when we do, and tell you directly about any material change.
11. Governing law
These terms are governed by the law of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
